Victor Land Holdings, LLC, Site Plan, CUP, Variance, and Easement Vacation
Page 2
2. CONTEXT:
A. Surrounding Land Use and Zoning
The properties to the north, east, and south are zoned General Industrial (I-3) and are occupied
by industrial users. The property across Fenway Boulevard to the west are zoned Medium
Density Multiple Family Residential (R-5) and are occupied by a water tower and a townhome
development.
B. Existing Site Characteristics
The property flat and there are no wetlands on the property.
3. ANALYSIS:
A. Level of City Discretion in Decision -Making
The City's discretion in approving or denying a site plan is limited to whether or not the
proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If
it meets these standards, the City must then approve the site plan.
The City's discretion in approving or denying a conditional use permit is limited to whether or
not the proposed application meets the standards outlined in the City's Comprehensive Land Use
Regulations. If it meets these standards, the City must then approve the conditional use permit.
The City's discretion in approving or denying a variance is limited to whether or not the
proposed project meets the standards in the Zoning Ordinance for a variance. The City has a
higher level of discretion with a variance because the burden of proof is on the applicant to show
that they meet the standards in the ordinance.
B. Site Plan
The application complies with the ordinance standards as follows:
Building Setbacks
The I-3 zoning district requires a 30-foot front and rear yard setback and a side yard setback
equal to the height of the building, in no case less than 10 feet. The site plan complies with the
setback requirements.
Building Height
The I-3 zoning district has a maximum building height of 50 feet. The building height will be
approximately 25 feet. The site plan complies with the height requirements.
