DESCRIPTION OF REQUEST: <br /> <br />The property is located at the northeast corner of 130th Street North and Fenway Boulevard <br />North. Currently it is two parcels and will be combined with this project and totals 1.6 acres. <br /> <br />The applicant is requesting a preliminary plat, final plat, and site plan for 3 one-story <br />office/warehouse buildings totaling 38,800 square feet. The three buildings will have a total of <br />14 office/warehouse units and each can accommodate a mezzanine. Some units will have an <br />outdoor balcony out of the mezzanine area. The applicant has stated that the users will be low <br />intensity users and possibly sold/leased to users that may want to store and work on collectable <br />vehicles. There will be three buildings on one common lot, therefore a conditional use permit <br />(CUP) is required to allow a campus development. The common space will be owned and <br />maintained by a property owners association with shared drive aisles and parking spaces. The <br />applicant is requesting a variance from the commercial and industrial construction standards to <br />allow the building to be built with architectural metal panels, where architecturally enhanced <br />concrete panel, architecturally enhanced masonry block, masonry with block, masonry with <br />exterior insulation and finish system (EIFS), brick, dressed stoned or glass are required by <br />ordinance. There are drainage and utility easements on the property that are not applicable to the <br />project and will be vacated with this project. New drainage and utility easements will be places <br />over the required areas such as the stormwater management facilities. <br /> <br />3. CONTEXT: <br /> <br />A. Surrounding Land Use and Zoning <br /> <br />The properties to the north, east, and south are zoned General Industrial (I-3) and are occupied <br />by industrial users. The property across Fenway Boulevard to the west are zoned Medium <br />Density Multiple Family Residential (R-5) and are occupied by a water tower and a townhome <br />development. <br /> <br />B. Existing Site Characteristics <br /> <br />The property flat and there are no wetlands on the property. <br /> <br />4. ANALYSIS: <br /> <br />A. Level of City Discretion in Decision-Making <br /> <br />The City’s discretion in approving or denying a preliminary plat, final plat, or site plan is limited <br />to whether or not the proposed project complies with the Comprehensive Plan and Zoning <br />Ordinance requirements. If it meets these standards, the City must then approve the site plan. <br /> <br />The City’s discretion in approving or denying a conditional use permit is limited to whether or <br />not the proposed application meets the standards outlined in the City’s Comprehensive Land Use <br />Regulations. If it meets these standards, the City must then approve the conditional use permit. <br />
