The City has a <br />higher level of discretion with a variance because the burden of proof is on the applicant to show <br />that they meet the standards in the ordinance. <br /> <br />B. Preliminary Plat/Final Plat/Site Plan <br /> <br />The application complies with the ordinance standards as follows: <br /> <br />Building Setbacks <br /> <br />The I-3 zoning district requires a 30-foot front and rear yard setback and a side yard setback <br />equal to the height of the building, in no case less than 10 feet. The site plan complies with the <br />setback requirements. <br /> <br />Building Height <br /> <br />The I-3 zoning district has a maximum building height of 50 feet. The building height will be <br />approximately 25 feet. The site plan complies with the height requirements. <br /> <br />Building Coverage and Lot Coverage <br /> <br />The ordinance limits lot area to be covered by a building to 40% and lot area to be covered by <br />impervious surface to 80%. The site plan complies with the coverage requirements. <br /> <br />Landscaping <br /> <br />Section 90-181 of the Zoning Ordinance provides landscaping requirements for industrial <br />development. The site plan includes tree and shrub locations and species. <br /> <br />The ordinance provides two ways of calculating the required amount of trees and shrubs. One <br />based on the square footage of the building and one based on the perimeter of the site, whichever <br />is greater. In this case staff used the perimeter of the site. In order to meet the landscape <br />requirements, 16 overstory deciduous trees, 16 coniferous trees, 16 ornamental trees, and 106 <br />shrubs are required to be installed. If the trees are installed, this would meet the ordinance <br />requirement for the entire campus development. <br /> <br />The applicant is proposing 16 overstory deciduous trees, 16 coniferous trees, 16 ornamental <br />trees, and 106 shrubs. <br /> <br />Lighting <br /> <br />The ordinance requires lighting to consist of cut-off fixtures and for light cast on adjacent <br />property and roads not to exceed ½ foot candle measured at the property line or 1 foot candle <br />measured at the street’s centerline. The ordinance also required the light fixtures, whether pole <br />mounted or wall mounted to be cut-off fixtures. The applicant is proposing LED lights for both <br />for the wall mounted fixtures.
