Hugo City Council Meeting Minutes for April 5, 2021 <br />Page 4 of 12 <br /> <br />Approve Resolutions Approving Variance and CUP Amendment for Xcel Energy - 13620 <br />Fenway Boulevard North <br /> <br />Xcel Energy currently owned and operated a training facility on property located at 13620 <br />Fenway Boulevard North and proposed to construct additional training facilities to include a <br />“mock” transmission line. The transmission line was proposed to have approximately 12 utility <br />poles of various types and heights. This required a Conditional Use Permit amendment to amend <br />the site plan for utility pole locations in the CUP. The applicant had also requested a variance <br />from the maximum building height for the training poles to be 72 feet tall, where 50 feet was <br />allowed by ordinance for structures and buildings. At its March 25, 2021, meeting, the Hugo <br />Planning Commission held a public hearing and considered the requests. There were no residents <br />who spoke during the public hearing. The Planning Commission found that the applications met <br />all requirements necessary for approval and recommended that the City Council approve the <br />variance and CUP amendment. Adoption of the Consent Agenda approved RESOLUTION <br />2021 – 20 APPROVING A VARIANCE FROM THE MAXIMUM BUILDING HEIGHT FOR <br />A TRANSMISSION TRAINING LINE ON PROPERTY LOCATED AT 13620 FENWAY <br />BOULEVARD, and RESOLUTION 2021-21 APPROVING A CONDITIONAL USE PERMIT <br />AMENDMENT FOR XCEL ENERGY TO AMEND THE SITE PLAN FOR THE PROPERTY <br />LOCATED AT 13620 FENWAY BOULEVARD NORTH. <br /> <br />Approve Property Line Adjustment on 9604 170th Street North – Scott Johnson <br /> <br />Scott Johnson had requested approval of a property line adjustment for properties located at 9604 <br />170th Street North. The applicant had proposed to adjust the common property line between the <br />two properties. The existing Parcel A was two acres and Parcel B was 37.33 acres. This adjustment <br />would result in Parcel A totaling 3.7 acres and Parcel B totaling 35.63 acres. Staff found that the <br />property line adjustment would reduce the extent of any nonconformities. Adoption of the Consent <br />Agenda approved RESOLUTION 2021-22 APPROVING A PROPERTY LINE ADJUSTMENT <br />FOR SCOTT JOHNSON FOR THE PROPERTIES LOCATED AT 9604 170TH STREET <br />NORTH. <br /> <br />Approve Resolution Approving the Encroachment Agreement for 4958 142 nd Circle North - <br />Octavio Chung Bustamante and Mary Chung <br /> <br />Octavio Chung Bustamante and Mary Chung had requested an encroachment agreement to allow <br />construction of a fence within a drainage and utility easement on property located at 4958 142 nd <br />Circle North. Staff had reviewed the request and recommended that the City Council approve the <br />encroachment agreement. Adoption of the Consent Agenda approved RESOLUTION 2021-23 <br />APPROVING AN ENCROACHMENT AGREEMENT FOR OCTAVIO CHUNG <br />BUSTAMANTE AND MARY CHUNG TO ALLOW CONSTRUCTION OF A FENCE <br />WITHIN A DRAINAGE AND UTILITY EASEMENT ON THE PROPERTY LOCATED AT <br />4958 142ND CIRCLE NORTH. <br /> <br />Approve Public Works Summer Seasonal Employees <br /> <br />Staff had requested authorization to re-hire seasonal employees for the public works
