Page 11 <br /> stormwater permit. A stormwater reuse agreement between the City and the applicant shall be <br /> recorded. The agreement will include provisions that will allow the City to operate the system in <br /> the event that it is necessary to maintain compliance with the stormwater permit. The provisions <br /> will include an ability to assess any City costs associated with operation and maintenance of the <br /> system. <br /> Staff is working with the applicant to determine whether or not the water reuse system will <br /> generate stormwater management credits beyond those required to meet their own permitting <br /> requirements. If that is the case, the City will include in its use agreement with the developer that <br /> excess credits generated are the property of the City. <br /> Wetlands <br /> The property includes some wetlands, which have been delineated and approved by the City as <br /> LGU. The applicant is proposing to impact 1 acres of the 26 acres of wetland for street <br /> construction and grading. The applicant has submitted a wetland replacement plan to the <br /> Technical Evaluation Panel (TEP) for approval of the wetland impacts. The wetland replacement <br /> plan will need to be approved prior to final plat approval of any phase. <br /> There is a trail along Oneka Lake on the plan. There are areas where a boardwalk will be <br /> installed for the crossing of the wetlands. The boardwalks will be designed to qualify for a no <br /> loss (no wetland impact) determination from the TEP. Staff will continue to work with the <br /> applicant on the design of the boardwalk. The boardwalk will maintain the 8-foot width of the <br /> trails they will connect to throughout the development. <br /> Homeowners Association <br /> A homeowners association(HOA) is proposed for the development. There are three housing <br /> styles, single family detached homes, villa homes, and twinhomes. All of the homes would be <br /> part of a Master HOA will be established for the development to own/operate/maintain <br /> community areas, landscaping, and the water re-use system. The HOA will also provide for <br /> restrictions on outdoor storage, parking(no boats, campers, or trailers) in order to keep the <br /> community looking orderly and well maintained. <br /> Preliminary Plat <br /> The preliminary plat consists of 218 residential lots and 10 outlots. The proposed use and <br /> ownership of each outlot are as follows: <br /> Outlot Acres Ownership Use <br /> A 1.54 Current Owner(Fenway Wetlands/Future <br /> Land Company) Development <br /> B 11.37 City of Hugo Stormwater management, <br /> wetlands, and right-of-way <br /> C 5.04 Current Owner(Fenway Future Development <br />
