Page 7 <br /> stormwater permit. A stormwater reuse agreement between the City and the applicant shall be <br /> recorded. The agreement will include provisions that will allow the City to operate the system in <br /> the event that it is necessary to maintain compliance with the stormwater permit. The provisions <br /> will include an ability to assess any City costs associated with operation and maintenance of the <br /> system. <br /> Wetlands <br /> The property includes some wetlands, which have been delineated and approved by the City as <br /> the Local Government Unit(LGU) The applicant is proposing to impact .75 acres of the 3.92 <br /> acres of wetland for grading and street construction. The applicant has submitted a wetland <br /> replacement plan to the Technical Evaluation Panel (TEP) for approval of the wetland impacts. <br /> The wetland replacement plan will need to be approved prior to final plat approval. The wetlands <br /> are also under jurisdiction of the Army Corp of Engineers. In addition to City approval, the <br /> replacement plan will need approval from the Army Corp of Engineers. The applicant has <br /> applied for the approvals. <br /> Homeowners Association <br /> A homeowners association (HOA) is proposed for the development. All of the homes would be <br /> part of a Master HOA that will be established for the development to own/operate/maintain the <br /> landscaping along Oneka Parkway and the water re-use system. The HOA documents shall be <br /> reviewed and approved by staff prior to the recording of the final plat for the first phase. <br /> Preliminary Plat <br /> The preliminary plat consists of 59 residential lots and 10 outlots. The applicant is required to dedicate 10% of <br /> the developable acres for park land with a density of less than 3.99 units per acre. With 24.83 <br /> buildable acres, 2.48 acres of land would be required to be dedicated. <br />
