Conditional Use Permit <br /> <br />General Standards <br /> <br />The Planning Commission must review the application for a conditional use permit with the <br />standards provided in Section 90-37 in the City Code. Staff used these standards to review the <br />application and found that the request meets the applicable standards as follows: <br /> <br />1. The proposed use is permissible by law. <br /> <br />An accessory apartment is only permitted in the Agricultural zoning district by a CUP, but is <br />otherwise permitted by law. <br /> <br />2. The proposed use is keeping with the spirit and intent of the ordinance. <br /> <br />The spirit and intent of the ordinance is to allow for living facilities dedicated for the use of <br />persons living separately from others in the building, while maintaining a single family residence <br />as the primary use of the property. The existing building has an area of 2,710 square feet, of <br />which 1,798 square feet is occupied by the house. The proposed building addition is <br />approximately 900 square feet, so staff is considering its footprint to be accessory to the existing <br />building. The proposed building addition will not dominate the appearance of the property or the <br />house it is attached to. The requested accessory apartment is keeping with the spirit and intent of <br />the ordinance. <br /> <br />3. The proposed use is compatible with the City’s Comprehensive Plan, and the character of <br />the surrounding area. <br /> <br />The use will not substantially alter the residential character of the property, which is a typical use <br />in areas that are zoned and guided as Agricultural. The City’s Comprehensive Plan identifies this <br />area as Agricultural. <br /> <br />4. The proposed use has adequate drainage, water supply, electrical, gas, and sewage <br />treatment facilities. <br /> <br />Staff does not foresee any problems with utilities or drainage. Prior to the issuance of a building <br />permit, the applicant must obtain a septic permit from Washington County. This is a condition <br />listed in the CUP. <br /> <br />5. The proposed use has adequate road access. <br /> <br />The use has adequate access onto Keystone Avenue North via the shared driveway on the adjoining <br />parcel to the north. <br /> <br /> <br />
