-4- <br /> 4. If sewer facilities are to be provided, they shall be of the por- <br /> table, <br /> or- <br /> table, chemical holding tank type. <br /> 5. A bond in the amount of $3,000.00 shall be posted for each of the <br /> three borrow pit sites, and a bond in the amount of $5,000. 30 <br /> shall be posted for the Duraine property. The bonds shall be <br /> performance bonds in the form approved by the City Attorney and <br /> written to insure compliance with the provisions of this special <br /> use permit. <br /> 6. The conditions of the special permit issued by the Rice Creek <br /> Watershed District for each of the sites shall be made a con- <br /> dition of this special use permit. <br /> 7. Inspection of the site shall be by the City Engineer and the bonds <br /> shall be released only after he 1has certified that the provisions <br /> of the special use⢠permit have been complied with. <br /> 8. Any violation of the condtions of this special cial use permit t shall <br /> p <br /> be gro4nds for termination of the permit, and final grading, <br /> sloping, and seeding shall then be at the direction of the City <br /> Engineer. <br /> 9. The special use permit shall.expire on September 30, 1975, and all <br /> conditions of it shall have been complied with by that date or it <br /> may be extended due to conditions beyond the contractors control <br /> to include labor relations or acts of God. <br /> 10. Dust shall be controlled on the haul roads by the contractor in <br /> accordance to the recommendations of the City Engineer. <br /> Additional conditions for the Durable Property: <br /> 1. As part of this special use permit, the applicant is authorized <br /> to operate a hot--mix asphalt plant. This plant shall be operated <br /> in compliance with the Minnesota Pollution Control Agency's <br /> Operating Permit Number 1022-73-0-1. <br /> 2. The bituminous hot-mix plant shall be placed in such a location <br /> that it has the least visual impact from the surrounding properties. <br /> The following conditions should be applied to the mining permits issued <br /> to Rehbein Contracting Company. There would be two mining permits, one <br /> covering the borrow pits and one for the mining and hot-mix plant on the <br /> Durkine property. <br /> 1. All applicable provisions of the City of Hugo ordinances governing <br /> mining shall be complied with. <br /> 2. This permit is issued for the purpose of removing borrow material <br /> of gravel for use on the job under contract with Washington County <br /> for work on County Road 4 and County Road 56. <br /> 3. No top soil or overburden shall be removed from the site. <br />
