Daycare facilities. <br />(a) It is unlawful for any person to construct or operate any daycare facility, except in accordance with this <br />chapter. <br />(b) The size of the play areas required, as well as qualifications for teachers and licensure must be in compliance <br />with Minn. Stat. §245A, as may be amended. <br />(c) The structure and operation shall be in compliance with State of Minnesota Department of Human Services <br />regulations and shall be licensed accordingly <br />(d) All exterior play areas for day care facilities must be surrounded by a minimum six- foot-tall fence. All <br />openings shall be controlled by doors or gates, and the fence shall meet all yard setback requirements. <br />(e) The following applies to family daycares: <br />(1) Family daycares must be accessory to a single-family home and are prohibited within any multi-family <br />use. <br />(2) Day care activities must not be conducted before 5:00 a.m. or after 9:00 p.m. in residential zoning <br />districts. <br />(f) The following applies to group daycares: <br />(1) Group daycares must be the principal use when permitted in the zoning district. <br />(2) Day care activities must not be conducted before 5:00 a.m. or after 9:00 p.m. in residential zoning <br />districts. <br />(3) Day care facilities located in residential zoning districts must be constructed to appear similar in scale, <br />color, and materials as homes in the district. <br />(g) The following applies to daycare centers: <br />(1) Off-street drop-off and loading areas must be provided which do not interfere with traffic and <br />pedestrian movements. <br />(2) All outdoor play areas must be screened with landscaping in addition to the required safety fence from <br />the ROW and abutting properties. <br />(Prior Code, § 1195-200.1, § 90-220) <br />Sec. 90-213. Distribution center. <br />(a) It is unlawful for any person to construct, operate, or maintain a distribution facility in the city, except in <br />conformance with this chapter. <br />(b) The main entrance to a distribution center must be located on a minor expander, minor connector, or a <br />major or minor collector. <br />(c) Exteriors of all principal and accessory buildings shall be of architecturally enhanced concrete panel, <br />architecturally enhanced masonry block, exterior insulation and finish system (EIFS), brick, dressed stone, or <br />glass. Colors shall be neutral or earth tones, except to create a decorative effect, 20 percent of the building <br />facade (excluding window and door areas from the computation) may be decorated with glazed tile, glass, <br />plastic or metal panels, or wood of various colors.
