Drive-through businesses. <br />(a) It is unlawful for any person to construct or operate a drive-through business, except in accordance with this <br />regulation. <br />(b) The main entrance to all drive-through businesses must be located on a state highway, county road, or city <br />commercial collector street. <br />(c) The minimum lot width of a drive-through business shall be 150 feet. <br />(d) All traffic utilizing the business, including vehicle parking, stacking and waiting areas, shall be provided for on <br />site and off public roads, alleys, and other easements. <br />(e) The drive-through lane shall provide a minimum of 180 feet of drive aisle stacking space. The lane shall <br />include the stacking area, order box and pick-up window. <br />(f) The lane shall be at least 200 feet from a residentially zoned property and meet all setback requirements. If <br />the lane is proposed to be closer than 200 feet from a residentially zoned property, a CUP shall be required. <br />(Prior Code, § 90-221 (Drive-In Businesses) & 90-221.1 (Drive-Through Businesses); Ord. No. 2010-453, § 2, 12-6- <br />2010) <br />Sec. 90-215. Driveways. <br />(a) It is unlawful for any person to construct or maintain a driveway, except in accordance with these <br />regulations. <br />(b) Driveways are allowed in all zoning districts of the city by permit issued by the city building official for <br />platted property, or the city engineer for unplatted property. <br />(c) Driveway access to all county roads and state highways requires a permit from the agency controlling the <br />road or highway. Private driveway access to County Road 4, County Road 8, and Forest Boulevard (T.H. 61) <br />will be allowed only where no viable alternative exists. <br />(d) Except in the long term agricultural, agricultural, rural residential, and future urban service zoning districts, <br />all driveways in the city shall be paved with bituminous, concrete, pavers, or other approved dustless and <br />erosion-resistant material. <br />(e) Driveways shared by two or more separate parcels or lots of land may be permitted only by conditional use <br />permit. An access easement and maintenance agreement shall be recorded against the properties that <br />contain the shared driveway. <br />(f) Driveways may cross or encroach upon wetland area only by permit from the appropriate regulatory <br />authority. <br />(g) Driveways may cross or encroach upon a public drainage easement only by conditional use permit. <br />(h) Driveways crossing a public road ditch in platted areas require a minimum 15-inch reinforced concrete pipe <br />with aprons. In other areas, a minimum 15-inch corrugated metal pipe is an acceptable alternative. A higher <br />standard in dimension or materials may be required by the city engineer for public safety or to maintain <br />drainage. Property owners are required to keep such culverts in good repair and free from obstructions.
