<br /> <br /> <br /> Created: 2025-05-22 16:40:53 [EST] <br />(Supp. No. 36) <br /> <br />Page 154 of 198 <br />(1) It is unlawful for any person to construct, operate, or maintain a commercial garage in the city, except <br />in conformance with this chapter. <br />(2) Commercial garages used only for the temporary parking of automobiles and light trucks for people <br />employed or conducting business in nearby buildings may be allowed as an accessory use in the <br />general business zoning district. <br />(Prior Code, § 1195-290.1, § 1195-530.1, § 90-229 (Garages, commercial) & 90-253; Ord. Places of assembly. <br />(a) It is unlawful for any person to construct, operate, or maintain a place of assembly, which includes public, <br />educational, private club, or religious facility, except in conformance with this chapter. <br />(b) Approval or denial of proposed development plans for place of assembly shall be based upon the following: <br />(1) The capability of the site to accommodate the building, parking and drives with appropriate open <br />space, and safe and easy ingress and egress, with direct access to a state highway, county road, city <br />collector street, or intersection of two collector streets. Access shall be prohibited on local residential <br />streets. <br />(2) A traffic management plan shall be submitted for approval by the Community Development Director <br />or designee. <br />(3) The building and site plan shall be compatible with the surrounding area. <br />(4) The building shall comply with the commercial and industrial construction standards in accordance <br />with section 90-268. <br />(5) The development shall comply with the height and area requirements outlined in the underlying <br />zoning district. <br />(6) If the building is located within a residentially zoned district and totals 20,000 square feet or more in <br />size, transitions will be required. These transitions may include: <br />a. Increased setbacks up to 50 feet from property lines. <br />b. Creation of a landscape buffer that may include features such as berms, evergreen trees, and <br />fencing. The landscaping shall be in accordance with section 90-236. <br /> c. Traffic and high activity areas shall be oriented away from residential property lines. <br />(c) Nothing in this chapter shall prohibit the use or establishment of a chapel or place of prayer in any building, <br />for use by people living or working in the building, so long as the use is clearly incidental to the principal use <br />of the building. <br />(d) Nothing in this chapter shall prohibit the home-based schooling of residents on their own property. <br />(Prior Code, § 90-254 (Places of worship) & 90-260 (Schools)) <br />Sec. 90-254. Plant nurseries. <br />(a) It is unlawful for any person to construct, operate, or maintain a retail or wholesale plant nursery, except in <br />conformance with this chapter. <br />(b) The following applies to wholesale plant nurseries:
