<br /> <br /> <br /> Created: 2025-05-22 16:40:53 [EST] <br />(Supp. No. 36) <br /> <br />Page 155 of 198 <br />(1) It is unlawful for any person to construct, operate, or maintain a wholesale plant nursery, except in <br />conformance with this chapter. <br />(2) The import, storage, processing, and distribution of plant materials grown off site may be allowed. <br />(3) Wholesale plant nurseries are subject to the following conditions and standards: <br />a. The city council may require a greater front yard setback in order to ensure that the proposed <br />greenhouse structures are compatible with the city's comprehensive plan and adjacent land uses. <br />b. Adequate parking and truck loading and maneuvering areas shall be provided on the site. <br />c. On-site storage and use of pesticides and fertilizers shall meet the standards of the state <br />department of agriculture. A chemical storage plan shall be provided to the zoning administrator <br />at the time of application for a conditional use permit to provide the city with the location, type, <br />amount, and storage method of pesticides, chemicals, and fertilizers kept on the site. <br />d. Operation of a landscaping business is not incidental to operation of a wholesale plant nursery, <br />and only equipment and machinery actively used and maintained for the principal purpose of <br />cultivating plants grown on site, or as allowed by the principal use of the property, may be stored <br />or maintained on the site of a plant nursery. <br />e. It is the intent of this section to allow landscaping plants, shrubs, trees, etc., to be grown as an <br />agricultural activity. <br />(c) The following applies to non-wholesale, or retail plant nursery retail: <br />(1) It is unlawful for any person to construct, operate, or maintain a retail plant nursery, except in <br />conformance with this chapter. <br />(2) Retail sales of the plants grown on-site are permitted, except that retail sales in the agricultural zoning <br />district will be allowed only if the principal road access to the site is a minor expander, minor <br />connector, or a major or minor collector. <br />(3) Retail sales of materials brought in from off-site may be allowed. <br />(Prior Code, § 1195-560.1, § 90-255 & 90-256; Ord. No. 2015-470, § 3, 5-4-2015) <br />Sec. 90-255. Recycling centers. <br />(a) It is unlawful for any person to construct, operate, or maintain a recycling center, except in conformance <br />with this chapter. <br />(b) All waste storage and recycling materials shall be maintained in a clean and sanitary condition, fenced or <br />enclosed, and screened from adjacent properties and public rights-of-way. Waste matter, rubbish, refuse <br />and recyclable materials shall be stored in a building, in a container with a lid or cover, or contained and <br />screened in a way approved by the city which is sufficient to mitigate visual and noise impacts. In the case <br />where the materials are stored in a building or contained in a way approved by the city, it shall be stored <br />upon an impervious surface. All materials shall be contained and stored in a method shown on a site plan <br />approved by the City and shall not otherwise accumulate loose on the property.
