9. <br />Ordinance 2010-`1 5 3 <br />Sec. 90-261. - Seasonal outdoor retail sales. <br />(a) It is unlawful for any person to operate, or allow to be operated, any seasonal outdoor <br />retail sales, except in conformance with this chapter. <br />(b) Seasonal outdoor retail sales are a permitted accessory use in the central business, <br />general business, and restricted commercial zoning districts for a period of time not to <br />exceed a combined total of 120 days in any 12 -month period. Outdoor retail sales shall <br />not occupy an area exceeding ten percent of a lot's area, and shall meet all yard setback <br />requirements. <br />(c) Where seasonal outdoor retail sales are conducted in a parking lot, they shall be <br />confined to a defined area, and not be allowed to obstruct access of emergency <br />vehicles, shall maintain good traffic circulation, and continue to provide adequate <br />parking for the primary use. Temporary fencing or other suitable mechanisms shall be <br />used to delineate the sales area and provide for pedestrian safety. <br />(d) Where tents, temporary greenhouses, or similar structures are used to store, and/or <br />display merchandise, they shall be anchored to provide a wind -load resistance of 40 <br />miles per hour. <br />Section 4. Severability. In the event that a court of competent jurisdiction adjudges any part of <br />this Ordinance to be invalid, such judgment shall not affect any other provision of this Ordinance <br />not specifically included with that judgment. <br />Section 5. Effective Date.
