Hugo City Council Meeting Minutes for January 6,2015 <br /> Page 7 of 10 <br /> the EDA received an update from the remaining realtor. The EDA agreed at the meeting that <br /> they were not getting what they expected and that they were not comfortable with the contact <br /> being with Wakota Commercial Advisors, LLC. The EDA collectively decided to issue a 30-day <br /> notice to Wakota Commercial Advisors, LLC in order to cancel the contract. <br /> Council Member Haas removed this from the Consent Agenda to suggest staff contact Louis <br /> Jambois from the St. Paul Port Authority, who has experience in this area of marketing. <br /> Haas made motion, Klein seconded, to approve the cancellation of the listing agreement with <br /> Wakota Commercial Advisors, LLC, for the city owned property in downtown. <br /> All Ayes. Motion carried. <br /> Approval of CUP for Additional Animal Units at 17260 Ingersoll Avenue North <br /> Cindy Bellamy and Shirley Smith had applied for approval of a conditional use permit(CUP)to <br /> allow double the amount of animal units allowed on property. The applicant is requesting to have <br /> 14 horses on the property,where seven are allowed by ordinance. The ordinance allows double <br /> the amount of animal units, with a CUP and an approved facilities and waste management plan. <br /> At its December 4,2014 meeting,the Planning Commission held a public hearing on the request <br /> and recommended approval to the Council with a 4-2 vote. At their December 15,2014 meeting, <br /> the Council considered this request and tabled it to allow the applicant an opportunity to work <br /> with staff on several items. <br /> Planner Rachel Juba provided update on those items which included working with the applicant <br /> on the number of horses, revising the plan for manure application and removal,evaluating the <br /> elevations of the paddocks and evaluating the culvert location. Conditions in the CUP were <br /> revised and staff was comfortable with the revisions. <br /> Haas asked if the number of horses allowed by ordinance with the CUP was double the amount, <br /> or up to double the amount. Staff explained it was up to double the animal unit density. <br /> Weidt stated he had talked to the applicant and was comfortable with staff recommendation and <br /> what the applicant has told him. <br /> Weidt made motion, Petryk seconded,to approve RESOLUTION 2015-1 APPROVING A <br /> CONDITIONAL USE PERMIT FOR CINDY BELLAMY AND SHIRLEY SMITH ON THE <br /> PROPERTY LOCATED AT 17260 INGERSOLL AVENUE NORTH. <br /> Haas stated he had spoken to residents who had requested an amendment to limit the number of <br /> horses to ten. Has made a motion to amend the motion to limit the number of horses to ten. <br /> Motion failed for a lack of a second. <br /> Aye: Petryk, Haas, Klein, Miron,Weidt <br /> Nay: None <br /> Motion carried. <br />
