Hugo City Council Meeting Minutes for September 8, 2015 <br />Page 4 of 6 <br />Public Hearing on the Easement Vacation for Petronack at 12997 Elmcrest Ave. N. <br />Community Development Assistant Rachel Leitz explained the request from Michael and Debra <br />Petronack to vacate the existing drainage and utility easement located over two properties that <br />have recently been combined into one lot. The applicant has received approval of a variance for <br />the location of an accessory structure with the condition that the two lots be combined. Now that <br />this process has been completed, the existing drainage and utility easement needs to be vacated <br />for the accessory structure to be built in the approved proposed location. Leitz explained that <br />staff has reviewed the application and is comfortable with the request to vacate the drainage and <br />utility easement. <br />Mayor Weidt opened the public hearing. There were no comments, and Mayor Weidt closed the <br />public hearing. <br />Miron made motion, Klein seconded, to approve the notice to vacate the drainage and utility <br />easement on property located at 12997 Elmcrest Avenue North. <br />All Ayes. Motion carried. <br />National Recvcling. Inc. CUP Amendment and Zoning Ordinance Text Amendment <br />Rick Mark, owner of NRI, had applied for a zoning ordinance text amendment to revise the <br />language in the performance standards for recycling centers. The applicant also requested a <br />Conditional Use Permit (CUP) amendment to revise the site plan and conditions listed in the <br />permit that allows for a recycling center on the property. <br />City Administrator Bryan Bear provided a comparison of the current conditions of the site to the <br />way it existed prior to the CUP approval in 2011 for a recycling center. The site was to be <br />cleaned up following an approved transition plan. NRI had a site in Cambridge to aid in this <br />plan; however, the site did not work how it was intended and is no longer a part of NRI. Bryan <br />presented photos showing a vast majority of the scrap removed in 2013 and improvements to the <br />site more recently. A pile of scrap still remained on the ground to be sorted. Bryan reminded <br />Council that at the May 18, 2015 Council meeting, Council encouraged the applicant to proceed <br />with an application to the Planning Commission for an amendment to the CUP and an Ordinance <br />text amendment to allow the City to approve alternates for the storage, addressing the visual and <br />noise impacts related to recycling materials on the ground. This would amend a current <br />condition of the CUP that states no storage shall be on the ground. Staff is comfortable with <br />allowing sorting and processing of scrap on the ground in a designated area to be surrounded by <br />concrete bunkers. Revised landscaping and screening will keep the area out of view from <br />Highway 61. <br />Bryan explained that the Planning Commission held a public hearing at their meeting on <br />September 24, 2015 and unanimously recommended Council approve the request. Bryan <br />recommend that, if Council was comfortable with approving the ordinance text amendment and <br />amended CUP, they should further terminate enforcement hearings and action earlier initiated by <br />the Council. <br />
