City Council meeting of December 2, 1991 Page _ Commission considered this matter at their meeting of November 26, 1991, and unanimously recommended approval of the request subject to special conditions. Jesinsk:i made motion, Brunotte seconded, to approve Certificate of Survey #12-2-91, and waiver of the formal platting requirements, for Arnie and Elvira Gruett to subdivide 12.89 acres .into two lots, one consisting of approximately 7.89 acres, and one of 5 acres. Parkland dedication is not required because no new lots are being created with this subdivision. Approval is subject to the following special conditions: 1. Survey approval shall be contingent on compliance with the survey conditions, as well as a grading, stormwater drainage plan, and the survey submitted. 2. All conditions of survey approval must be met prior to the stamping of any deeds for recording by the cit`f' clerk: unless permitted by council action. 3. The property lines on site be identified by the owners to assure property setbacks when buildings are to be constructed .if required by the building inspector. All lots must be properly staked. 4. Proposed driveway or drainage areas within the area surveyed must include the installation of a minimum 15" diameter-, corrugated metal culvert in a manner acceptable to the Gity. 5. No building permits shall be issued until survey has been approved and recorded with Washington County. 5. All conditions of approval by Rice Creek Watershed District must be complied with. 7. All fees relating to this subdivision shall be paid by the applicant including the cost of recording documents with Washington County. 8. Any driveway permits requiring access to highways or county roads may not be issued until the necessary permits are secured from Washington County. 9. The minimum lowest floor elevation on Parcel B shall be 2' above the 100 year flood mart: or 4' above the high groundwater mark:, whichever is greater. 10. No improvements, grading, or landscaping __.hall be permitted in the identified drainage arvaR without the express written authorization of the City and the appropriate watershed district.. 11.. All property owners shall be responsible for maintenance of drainage areas within easements on their property. The owners shall :-amply with all conditions and restrictions applicable to identified wetlands. 12. The developer shall permit access to the referenced site for periodic inspections to assure conformance with the conditions of survey approval. All aye. Motion Carried.
