City Council meeting of 2/21/89 <br />Page 3 <br />to shooting noise at the Bald Eagle Sportsman's Club. Following the <br />public hearing held by the Hugo Planning Commission on September 23, 1988, <br />said commission unanimously recommended approval of the preliminary plat <br />subject to the special conditions. The developer has been working closely <br />with the city staff and city engineer to adequately address the concerns <br />raised by the planning commission and others who attended the planning <br />commission meeting. The city staff now feels more comfortable with this <br />subdivision development than when originally proposed, and can see no <br />major objections at this time. <br />Mr. Steve Sondrall, representing Keystone Builders, agreed with the <br />Planning Commission's special conditions, with the exception of providing <br />an access easement for the purpose of installation of a civil defense <br />siren, and notification of future lot purchasers of the proximity of the <br />Bald Eagle Sportsman Club to the subdivision. <br />Michael Massie, adjoining property owner, questioned the financial <br />participation of abutting property owners for the future improvement of <br />125th Street. He inquired whether the developers would identify what <br />vegetation would be destroyed and what would remain. Mr. Massie did not <br />feel that this development would be a good location for a siren, and would <br />prefer that the siren be located on city property adjacent to Sunset Lake. <br />McAllister made motion, Jesinski seconded, to approve the preliminary plat <br />for Irene Arcand and Robert Kiewel for the subdivision of a 160 acre tract <br />of land into 32 lots to be known as DELLWOOD RIDGE. The property is <br />generally described as the eastern 1/2 of the southeast 1/4 of Section 33, <br />T31N, R21W, and the western 1/2 of the southwest 1/4 of Section 34, T31N, <br />R21W. Approval is subject to the following special conditions: <br />1. All fees relating to the subdivision shall be paid by the applicant <br />including the cost of recording documents with Washington County. <br />2. All interior roadways shall be installed as per city ordinance and the <br />city engineer's recommendations. <br />3. The city shall waive the requirement for installation of curb and <br />gutter except where required by the city engineer. <br />4. The developer shall consider a 50' X 50' access easement to Lot 2, <br />Block 3, for the purpose of installation of a civil defense siren. <br />5. The developer shall deposit with the city a non-refundable check in <br />the amount of $12,000 to cover administrative, legal, engineering, and <br />other related costs incurred by the city to accommodate this <br />development. <br />6. The developer and subsequent land owners must notify potential <br />purchasers of lots within this development of their proximity to the <br />Bald Eagle Sportsman Club prior to the purchase of said lots. The <br />method of notification to potential purchasers shall be reviewed by <br />the city to assure compliance. <br />7. Restrictive covenants shall be provided prohibiting the resubdivision <br />of lots within this development. <br />8' All advertising on site shall be limited to that as shown on the <br />preliminary survey and as permitted by the sign ordinance for model <br />homes. <br />
