V January 5, 1987 <br />the Purchase of Service Agreement is being provided in an effort to outline <br />what services the City will received for the $2150.00 (not to exceed) to be paid <br />to the Youth Service Bureau. In addition to outliningthe services to be provided, <br />the agreement also provides for a method of payment for services, reporting and <br />information requirements, designation of fiscal agent, and an indemnification <br />and insurance clause holding the City harmless, and providing for the required <br />limits of liability insurance as per Minnesota Statute. Attorney Johnson reviewed <br />the proposed agreement and recommended the following changes be incorporated: <br />3.A. The City shall pay the Contractor an amount not to exceed the sum listed <br />in Paragraph 1.A., for services provided. <br />6.A. The contractor does hereby agree that it will at all times hereafter <br />during the existence of this Agreement hold harmless the City, its Council, <br />employees, and agents, against any and all liability, etc. <br />Motion made by Potts, seconded by Vail, that the Mayor and City Clerk be authorized <br />to execute the Purchase of Service Agreement with the Forest Lake Youth Service <br />Bureau after the above mentioned changes as made by the City Attorney are incorp- <br />orated into the Agreement. <br />VOTING AYE: Olson, Potts, Vail, Atkinson <br />VOTING NAY: Peltier Motion Carried. <br />9.5 Dedication of Road Easement (Howard Schletty) <br />Howard Schletty has requested that the City formally accept the dedication of a <br />road easement in conjunction with the Certificate of Survey prepared April 15, 1986, <br />and subsequently approved by the City Council. The property in question is <br />generally identified as part of the NZ of the NWa of Section 28, T31N, R21W, <br />Washington County, Minnesota. When the property in question was initially sub- <br />divided into Parcels A, B, and C, as per the Certificate of Survey, an easement <br />was shown supposedly identifying the location of the existing roadway. Recently <br />it was discovered that the easement was placed in the incorrect location on the <br />original instrument of dedication as well as the Certificate of Survey on file <br />with Washington County. To correct this problem, Mr. Schletty is requesting that <br />the new easement dedicated to the City be accepted to properly identify the roadway <br />which has been maintained by the City since approximately the mid -1960's. The <br />shaded area, as indicated in the photocopy of the survey on file,.indicates the <br />location of the roadway and the proposed easement in question. The dashed -shaded <br />area is the location of the current easement which was apparently an error and <br />is the easement of record. <br />Motion made by Potts, seconded by Olson, to accept the Easement for Public <br />Highway as dated 12/29/86. <br />VOTING AYE: Olson, Potts, Vail, Atkinson <br />ABSTAINED: Peltier <br />Motion Carried. <br />GAMBLING LICENSE - Forest Lake Area Hockey Assn (Blacksmith Lounge) <br />A representative from the Forest Lake Hockey Assn., was present requesting the <br />City waive the 30 day time requirement needed by the State Gambling Board so <br />that they could sell pull -tabs at the Blackmith Lounge within the "hockey season". <br />Ken Huber stated that the State issues the Gambling License, but the community <br />is provided the opportunity to make comment should they have a problem with the <br />liquor business. <br />
