V January 5, 1987 the Purchase of Service Agreement is being provided in an effort to outline what services the City will received for the $2150.00 (not to exceed) to be paid to the Youth Service Bureau. In addition to outliningthe services to be provided, the agreement also provides for a method of payment for services, reporting and information requirements, designation of fiscal agent, and an indemnification and insurance clause holding the City harmless, and providing for the required limits of liability insurance as per Minnesota Statute. Attorney Johnson reviewed the proposed agreement and recommended the following changes be incorporated: 3.A. The City shall pay the Contractor an amount not to exceed the sum listed in Paragraph 1.A., for services provided. 6.A. The contractor does hereby agree that it will at all times hereafter during the existence of this Agreement hold harmless the City, its Council, employees, and agents, against any and all liability, etc. Motion made by Potts, seconded by Vail, that the Mayor and City Clerk be authorized to execute the Purchase of Service Agreement with the Forest Lake Youth Service Bureau after the above mentioned changes as made by the City Attorney are incorp- orated into the Agreement. VOTING AYE: Olson, Potts, Vail, Atkinson VOTING NAY: Peltier Motion Carried. 9.5 Dedication of Road Easement (Howard Schletty) Howard Schletty has requested that the City formally accept the dedication of a road easement in conjunction with the Certificate of Survey prepared April 15, 1986, and subsequently approved by the City Council. The property in question is generally identified as part of the NZ of the NWa of Section 28, T31N, R21W, Washington County, Minnesota. When the property in question was initially sub- divided into Parcels A, B, and C, as per the Certificate of Survey, an easement was shown supposedly identifying the location of the existing roadway. Recently it was discovered that the easement was placed in the incorrect location on the original instrument of dedication as well as the Certificate of Survey on file with Washington County. To correct this problem, Mr. Schletty is requesting that the new easement dedicated to the City be accepted to properly identify the roadway which has been maintained by the City since approximately the mid -1960's. The shaded area, as indicated in the photocopy of the survey on file,.indicates the location of the roadway and the proposed easement in question. The dashed -shaded area is the location of the current easement which was apparently an error and is the easement of record. Motion made by Potts, seconded by Olson, to accept the Easement for Public Highway as dated 12/29/86. VOTING AYE: Olson, Potts, Vail, Atkinson ABSTAINED: Peltier Motion Carried. GAMBLING LICENSE - Forest Lake Area Hockey Assn (Blacksmith Lounge) A representative from the Forest Lake Hockey Assn., was present requesting the City waive the 30 day time requirement needed by the State Gambling Board so that they could sell pull -tabs at the Blackmith Lounge within the "hockey season". Ken Huber stated that the State issues the Gambling License, but the community is provided the opportunity to make comment should they have a problem with the liquor business.
