20 February 18, 1986 <br />Chalupsky - continued <br />MOTION: McAllister made motion, Hauer seconded, to approve the Special Use Permit <br />for Lloyd Chalupsky to fill Lot 3, Block 1, Royalhaven Estates, with <br />material from Lot 9, subject to the following conditions being met: <br />1. Deposit $300.00 to cover all legal and engineering fees incurred. <br />2. Applicant to dedicate a 10' drainage easement to the City of Hugo, <br />along each property line, north and south, from the lake to the <br />road (Lot 3). <br />3. Perc test and drainfield location should be determined before a <br />Building Permit is issued. <br />4. A hold -harmless clause to the City of Hugo be signed to cover any <br />damage resulting from the filling. <br />5. Building foundation to be on undisturbed land. <br />6. All slopes should be 3:1 or greater. <br />7. Applicant to maintain or establish outlet as proposed on plan. <br />8. Applicant to obtain a permit from the RCWD. <br />9. Work shall begin within one year. <br />10. The applicant shall execute an agreement giving the City of Hugo <br />a satisfactory drainage easement as discussed with the City Engineer <br />and City Attorney. <br />11. No Certificate of Occupancy shall be issued and no person shall <br />occupy any residence on Lot 3 until final site plan approval is <br />granted by the City Engineer. <br />All aye. Motion Carried. <br />6.0 ORDINANCES AND RESOLUTIONS - No discussion. <br />7.0 UNFINISHED BUSINESS <br />Dave Moris, Granada Builders, stated that they had constructed a house for Bob <br />Ellman, 15729 Jeffrey Avenue, and were unable to complete the installation of the <br />septic system (no drainfield). Mr. Moris stated that they need approval from the <br />city that the home owner can occupy the house without a drainfield. The lending <br />institution will not close on the loan without this approval. There is a 1200 <br />gallon tank that will have to be Pumped until the system can be completed. <br />MOTION: McAllister made motion, Potts seconded, that the City Clerk be authorized <br />to issue a letter to Mr. Bob Ellman, 15729 Jeffrey, that he is authorized <br />to occupy the premises without a septic system being completed. Mr. <br />Ellman to provide the Clerk's office with a signed contract with a pumping <br />contractor, and evidence to the city that the system will be pumped as <br />necessary. The occupant shall vacate the premises upon any order from <br />the city's Building Inspector that the pumping is not being done. <br />All aye. Motion Carried. <br />Let the record show that the owner was agreeable to have this authorization <br />rescinded should the septic system not be completed by May 15, 1986. <br />KUBITSCHEK AND PETERSON <br />Councilman Hauer worked with Engineer Kuusisto to Establislcertain conditions to be <br />attached to Kubitschek and Peterson's application for a SUP to fill their lots on <br />.Bald Eagle Lake.
