21 <br />February 18, 1936 <br />both agreeable to the terms, but that Frank Kubitschek hoped to obtain a Building Permit <br />even though the drainfield would not be constructed. <br />MOTION: Hauer made motion, Peltier seconded, to approve the Special Use Permit for <br />Frank Kubitschek to fill Lot 7, Block 1 (93545-2320). Authorization is subject <br />to the following conditions being met: <br />1. The City of Hugo shall retain two easements consisting of 10' widths <br />on both the North and South boundaries of the property extending from <br />Ethan Avenue to Bald Eagle Lake. Fill material shall not be placed <br />to obstruct either easement. <br />2. Fill for the drainfield shall be of select material that meets the <br />approval of the City Engineer. Such fill should be left in place for <br />approximately one year before installing the drainfield unless an <br />alternate method of stabilizing the soil meets the approval of the <br />City Engineer. <br />3. Percolation tests shall be conducted to determine the adequacy and <br />location of any on-site disposal system. If tests prove unsatisfactory, <br />corrections shall be made subject to approval by the City Engineer until <br />a satisfactory on-site disposal system can reasonably be believed to <br />be constructed. A mound -type system could be used as a last alternative. <br />The Building Inspector may issue a Building Permit for the residence <br />before the actual construction of the disposal system after the above <br />mentioned plans and tests are approved by the City Engineer. Fill from <br />the excavation from the residence should not disturb the fill required <br />for the drainfield. <br />4. Foundations for the building should be on undisturbed soil or otherwise <br />meet the approval of the Building Inspector. <br />5. Driveway culvert shall be no less than 15" in diameter. <br />6. Any other items required from any other body, such as RCWD or the DNR, <br />shall be adhered to, including no fill past 913' high water mark as <br />directed by RCWD. <br />7. The permit holders, assignees, transferees, or heirs shall forever agree <br />to hold the City of Hugo harmless from any action or liability or dispute <br />resulting from the building of any residence or disposal system on the <br />described piece of property. <br />All aye. Motion Carried. <br />MOTION: Hauer made motion, Peltier seconded, to approve the Special Use Permit for <br />Jeffrey Peterson to fill Lot 7, Block 1 ((3545-2335). Authorization is <br />subject to the following conditions being met: <br />1. The City of Hugo already owns a 10' drainage easement on the northern <br />boundary of this property from Ethan Avenue to Bald Eagle Lake. In <br />addition, the City shall retain an additional easement consisting of <br />the southern most 10' of the property extending from Ethan Avenue to <br />Bald Eagle Lake. <br />2. In addition, another easement, 10' in width and 45' in length, shall be <br />retained by the City in the northeast corner of the property that extends <br />south from the north line abutting the west right-of-way line of Ethan <br />Avenue. This would allow the existing diagonal culvert under Ethan Avenue <br />to drain low areas to the east by allowing water to flow in a northerly <br />direction into the already existing east -west drainage easement at the <br />northern end of the property. This easement shall remain unobstructed <br />and, if necessary, in the opinion of the City Engineer, a pipe system <br />installed to deflect water northerly to connect with said east -west <br />drainage. <br />(continued) <br />
