April 15, 1985 Walter Scheerer MOTION: Hauer made motion, Peltier seconded, to approve the Site Plan for Walter Scheerer to construct an earth shelter home subject to review of the drainage plan by the City Engineer. Mr. Scheerer to place a fence or shrubbery in such a way as to obstruct access to the elevated roof. All aye. Motion Carried. 5.5 Gary Olson - Farm Site Plan MOTION: Potts made motion, Peltier seconded, to approve the Farm Site Plan for Gary Olson to construct a 106 x 180 pole barn subject to Mr. Olson's storing all manure so as not to drain into the creek. All aye. Motion Carried. 5.6 Margaret Doerrer - Site Plan Approval MOTION: Hauer made motion, Peltier seconded, to approve the Site Plan for Mar- garet Doerrer for the construction of a 1620 sq ft pole barn for her personal use only. All aye. Motion Carried. 5.7 Dave Mastd - Special Use Permit Mr. Mastel had wanted to install an ATV track on property belonging to the Caruth family. The Planning Connnission had held a public hearing with much opposition from the adjoining property owners. The PC recommended denial, at which time Mr. Mastel stated that he would not be going to the Council with his application. 35 MOTION: McAllister made motion, Peltier seconded, that the clerk write Mr. Mastel stating that it is the City Council's understanding that he has withdrawn his application to operate an ATV park. The $500.00 deposit as well as the $65.00 application fee will be refunded in its entirety. All aye. Motion Carried. 5.8 Greg Cardinal - Land Division MOTION: Potts made motion, Peltier seconded, to approve the Land Division for Greg Cardinal to divide 40 acres into two 20 acre parcels. All aye. Motion Carried. UNFINISHED BUSINESS The Council further discussed the Oneka Lake matter with the City Attorney. Mr. Johnson stated that the City has four options: 1. Do nothing. 2. Negotiate for some form of settlement, either with Alex Zaluckyj or some- body else.
