44 May 20, 1985 <br />Sheron Peltier - Rezonin <br />avoided: destroy surrounding property values, contract zoning, spot zoning <br />(wide divergence of land use), and personality of applicant. Mrs. Peltier <br />submitted a letter with 44 signatures stating that they are not opposed to <br />the rezoning application. Attorney Johnson stated that petitions are not an <br />issue in rezonings. There were a number of neighbors present to state their <br />objection to the request. <br />MOTION: McAllister made motion, Hauer seconded, to adopt ORDINANCE 1985-219, <br />AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED <br />"ZONING" BY AMENDING THE ZONING CLASSIFICATION REAL PROPERTY. <br />VOTING FOR: Peltier, McAllister <br />VOTING AGAINST: Hauer, Potts, Schwab <br />Motion Failed. <br />Hauer stated his reason for the "no" vote was to avoid the creation of an <br />"island" (RR2) in the middle of a 10 acre sea (AG). Approving the rezoning <br />would put pressure on the surround area. Schwab and Potts agreed with Hauer's <br />reasoning. <br />5.3 Richard Brandt - Auto Dismantling License <br />Mr. Brandt's application is for the yard formerly known as Len's Auto Parts. <br />Brandt has been working with Engineer Kuusisto to try to satisfy the require- <br />ment for monitoring wells on the property. For the record, the city will <br />accept the standards for monitoring wells as set forth by the city engineer. <br />The Planning Commission reconvended approval subject to certain conditions <br />being net, specifically, screening the yard to the south and east, and re- <br />moval of the "junk" between the fence and Highway 61. It was the concensus <br />of the Council that Mayor McAllister take a look at the situation. <br />MOTION: Potts made motion, Peltier seconded, to renew the Auto Dismantling <br />License for !?ichard Brandt for a one year period. <br />All aye. Ll,!otion Carried. <br />M02IOJ: McAllister made motion, Peltier seconded, directing the Planning <br />Commission to review the original and amended Special Use Permit as <br />previously issued to Len Noack, and in particular, to address <br />screening and tree conditions. <br />All aye. Motion Carried. <br />5.5 Will Harris - Site Plan Approval <br />Mr. Harris would like to construct a 24 x 32 pole building on property ad- <br />joining the Texan Bar (30 acres to the east). The building would be used for <br />storage of equipment and materials. Our computer printout states that Don <br />Bumgarner is the owner of the real estate. Mr. Harris stated that that has <br />changed, and that the corporation has purchased the property. Harris stated <br />that he would like to install ballfields at a later date. McAllisted determined <br />
