50 June 18, 1984 <br /> driveway. It was their impression that as long as they owned 35 acres that they <br /> qualified for a farming operation. Mayor McAllister stated that some of the <br /> material placed on their property could not be considered "clean fill" and that <br /> he would be making an on-site inspection of the property. As far as the animals <br /> are concerned, McAllister informed the Sathre's that their land was zoned residential <br /> not agriculture, regardless how many acres they had. They need a Special Use Permit <br /> to keep non-domestic animals in their zone. The Clerk was instructed to provide <br /> the necessary application and copy of the City code to Mr. Sathre, and they be placed <br /> on the agenda for the Planning Commission meeting of June 27th. <br /> 5.4 Norm Horton - Auto Dismantling License <br /> Because the application fee has not been paid, the matter was referred to the next <br /> Council meeting. <br /> 5.5 Leroy McCullough - Minor Subdivision <br /> Mr. McCullough has made application for the division ofhiece of property into <br /> two lots along Highway 61 . James Flannery, attorney for Mr. McCullough, was present <br /> at the meeting. Curt Leibel, purchaser of one lot, has been issued a cease workorder <br /> from Rice Creek and the City for filling of his property. It was determined that <br /> the lots created, as indicated on the Certificate of Survey, do not meet the 100' <br /> width requirement. Both lots need a variance. Mayor McAllister stated that even <br /> if the lots are divided, there is no certainty that they will be buildable. <br /> 5.6 William Pavek - Variances <br /> Mr. Pavek, 12582 Ingersoll Avenue, would like to make two additions to his resi- <br /> dence, an entryway that faces Ingersoll, and replace existing deck with a basement <br /> and solar porch. The Council recessed the regular meeting to make an onsite in- <br /> spection of the property. <br /> MOTION: McAllister made motion, Peltier seconded, to approve the variances (2) for <br /> William Pavek, 12582 Ingersoll Avenue, to construct the following: <br /> 1. An addition to the east side of his residence per the attached site <br /> plan, and, <br /> 2. A variance to replace the existing deck with a 12 x 30 addition with <br /> a basement. <br /> All aye. Motion Caried. <br /> 5.2 John Kostuch - Rezoning <br /> Mr. Kostuch, owner of property on 140th and Fenway, is proposing the rezoning of <br /> approximately 17 acres from RBI and Industrial to the SFU district. The Planning <br /> Commission recommended approval of the application. <br /> MOTION: McAllister made motion, Peltier seconded, to adopt ORDINANCE 1984-206, <br /> AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" <br /> BY AMENDING THE ZONING DISTRICT CLASSIFICATION OF DESCRIBED REAL PROPERTY. <br /> VOTING FOR: Peltier, Atkinson, Schwab, McAllister <br /> Motion Carried. <br /> Approval is contingent on Mary Doherty signing the application for rezoning. <br />
