190 Jim Mugge appeared with Don Hult for discussion on Hardwood Creek Estates. <br /> The engineer for Rice Creek Watershed had called the clerk's office to <br /> give their okay on the plat, and a letter had been received from the <br /> State Highway Deaprtment giving their approval also. Mr. Hult said they <br /> would like to get preliminary approval in order to get the road built <br /> and surveying done this year. Motion made by Martin and seconded to <br /> approve Preliminary Plat of Hardwood Creek Estates subject to the <br /> following conditions: <br /> 1 . Engineer's report be submitted to the City Council prior to its <br /> action on the application. <br /> 2. Written permission from the Northern Natural Gas Company for the <br /> construction of 177th Street on the eastern portion of the plat to <br /> the developer and be submitted to the City Council prior to its <br /> approval. <br /> 3. A portion of the property shown on the plan but not platted to the <br /> north of Hardwood Creek be designated as Outlot A. That portion of <br /> the property shown on the plan but. not platted on the westerly side <br /> of the plat line between Hardwood Creek and proposed 177th Street be <br /> designated Outlot B. That portion of the property shown on the plan <br /> but not platted on. the westerly side of the property line between <br /> 177th Street and the southerly property line be designated as Outlot C. <br /> All references to reservation for future of commercial development <br /> of above Outlot B and C be removed from the plan. <br /> 4. That a secenic easement be granted to the City of Hugo over Outlot A <br /> described above and working arrived at prior to final plat approval. <br /> 5. That parkland dedication in the amount of $1500.00 in addition to <br /> the scenic easement, be made to the City of Hugo. <br /> 6. That all proposed restrictive covenants be submitted to and reviewed <br /> by the City Attorney prior to the consideration of the plan by the <br /> City Council. <br /> 7. That 177th Street as proposed, shall be constructed by the developer; <br /> being a gravel surface road, 7 ton load, as approved by the City <br /> Engineer. <br /> 8. A bond shall be required from the developer in an amount to insure <br /> the construction of the proposed road. Said bond to be in accordance <br /> with the recommendation of the City Engineer, and s hall continue in <br /> force until deemed acceptable by the City Engineer. <br /> 9. That all homes within the plat be constructed at a distance no more <br /> than 400 feet from the 177th. St. North. <br /> 10. The right of access to each lot shall be dedicated to the City <br /> except access to 177th St. No., with the acception of Lot 7, Block 1 , <br /> which will have access to the Northern 200 feet South of the Pipeline <br /> Easement. <br /> 11 . Approval of Rice Creek Watershed be received by the City. <br /> 12. Prior to acceptance of final plat, City Engineer will recommend <br /> the amount of the performance bond. <br /> Motion carried. <br /> Mr. Neil Ganoe appeared regarding obtaining a Minor Subdivision from the <br /> Harold Caruth property on 165th Street. Motion made by Martin, seconded <br /> by Leroux to grant a Minor Subdivision to Neil Ganoe under Subdivision K <br /> of the Subdivision Ordiance regarding Hardship in condition of the land, <br /> and subject to the four conditions of the planning commission. Motion <br /> carried. <br /> Mrs. Norm Horton Sr. appeared regarding obtaining a renewed special use <br /> permit and junk yard license. LaValle mentioned he was not staisfied with <br /> the tree planting, and there was no provision of off street parking. <br /> He was at a fire there a week ago, and they had to move equipment for <br /> the firemen to get into the yard. He also said they would run the yard <br /> in Hugo the way the St. Paul yard is run and there would be no problem. <br />
