NOVEMBER 4, 1974 6 i �1► <br /> It was reprted that the final assessment roll was with Ehlers for final <br /> computation. Lease suggested that Bob take a look at the rates for sewer. <br /> Police Chief, Robert Barth had submitted a written report which was <br /> accepted as is. <br /> Charles Johnson submitted his written report along with a few other <br /> comments. Last Tuesday, October 29, Mr. Johnson' s office was given a <br /> telephone notice of about 1 day that there was a temporary restraining <br /> order hearing scheduled in the Distric Court, Washingto) County against <br /> the city, White Bear Rod and Gun Club and LaValle Excavating. The judge <br /> set a heari:.g on whether or not the restraining order should be made <br /> permanent or not for Thursday, October 31st. Mr. Johnson stated he <br /> appeared, the Gun Club appeared and the Attorney General' s office <br /> appeared for the Enviornmental Quality Council and at that time he moved <br /> to have the City of Hugo dismissed from the lawsuit completely which <br /> the judge granted. The White Bear Rod and Gun Club moved to have the <br /> restraining order lifted until after the EQC meeting of November 12th <br /> and the judge granted that order and continued the matter until Novermber 141 <br /> Mr. Johnson also received a telephone call on November 1st informing him <br /> that there is a meeting of the EQC Technical staff on November 5th at <br /> 9:00 AM in the Capital Square Building to review the environmental <br /> assessment. Attorney Johnson recommended that someone be there to <br /> represent the city. LaValle moved and Smith seconded that Attorney <br /> Johnson represent the city at the meeting of the EQC Technical Staff <br /> on November 5, 1974 at 9:00 AM at the Capital Square Building in St. Paul <br /> Motion carried. <br /> Attorney Johnson also stated that Mr. Card's attorney had contacted him <br /> regarding the building permit matter. Mr. Card's attorney suggested <br /> that a meeting be held between Mr. Card's attorney, the building inspector, <br /> and Mr. Johnson to try and resolve the matter. Mr. Card's attorney has <br /> been notified as to the vasis of non-action on the building permit <br /> applciation and the reasons for non-action. At this time the permit has <br /> neither been approved or denied and Mr. Card still feels he should be <br /> given the permit. Lease requested Attorney Johnson to write a letter to <br /> Mr. Card's attorney stating we had not received the necessary information <br /> requested in his original letter. <br /> Attorney Johnson requested the Clerk's office to send special letter to <br /> Joe Ohman, Vern Pelolquin, Harley Johnson and Ed Waugh regarding the <br /> Council's decision on their assessments. <br /> Lease asked Attorney Johnson about the Bayless matter. Johnson stated <br /> the matter is in discovery process now and there is no indication as to <br /> when we might come to trial. <br /> Mr. Johnson mentioned that there will be a symposium an law inforcement <br /> (Washington County orientated) on Novmeber 15th and 16th to be held in <br /> Hudson, Wisconsin and he feels that Chief Barth should attend if at <br /> all possible. Motion was made by Martin, seconded by Smith that Police <br /> Chief Robert Barth attend the symposium on law inforcement to be held <br /> on November 15th and 16th to be held in Hudson, Wisconsin. Motion <br /> carried. Mr. Johnson will have a copy of the letter regarding this <br /> symposium sent to Cheif Barth. <br />
