The injunction that was issued is stayed pending the filing <br /> of that appeal. RICCI - Storm Sewer EASEMENT - approved by attorney- <br /> now is recordable. <br /> MOTION: Lease made motion, seconded by Schletty, to enter into <br /> an agreement with Robert and Georgette M. Ricci, and to <br /> pay $300. 00 damage payment on the Ricci property. <br /> VOTING FOR: Lease, Leroux, Schletty and Smith. <br /> MOTION CARRIED <br /> Attorney announced that the water line on 148th Street has been <br /> constructed. LaValle to get contract and bond in cor.formance. <br /> GEORGE ]SING property - city has been notified that there will <br /> be a hearing in probate court to abandon the property. <br /> MOTION: Lease made motion, seconded by Schletty, to notify the <br /> courts, we would like to get back our assessment costs <br /> in the George King property. <br /> VOTING FOR: Lease, Leroux, Schletty and Smith. <br /> MOTION CARRIED <br /> 6.9 Engineer <br /> 6.9.1 Hintz Waller Water Problem-Rice Creek Report <br /> Engineer met with Vail and reviewed the report that had been sub- <br /> mitted by Rice Creek to Vail, regarding drainage now contributing <br /> to pond adjacent to Homestead Avenue. Suggests deverting flows from <br /> east side of Hyde Avenue easterly, construct a structure to ret'tin <br /> water east of existing culvert at east end o_' gond, to remove <br /> stumps and debris from ponding areas and to construct dike at <br /> south end of pond, installing drainage pipe through dike to provide <br /> pond level adjustment. Developer will have to work out details <br /> and submit to City and after approval, permit will be required <br /> from Rice Creek Watershed Distric .;. Clerk to obtain letters prior <br /> to next meeting. <br /> Lease would like to meet with Rice Creek and set up some rules and <br /> guidelines regarding the SUNSET LAKE problems so that if people <br /> do their own work they will know they are in compliance with both <br /> the city and Rice Creek. A firm would be required to do the testing <br /> and formulate a plan which would then be submitted for approval. <br /> After work was completed, it would be inspected to ascertain that <br /> the system was installed adequately. Engineer instructed to set <br /> up meet4.ng with Rice Creek. Lowering the lake is another problem, <br /> Lease said, and that will have to be treated separately. <br /> Engineer suggested that a ten day extension:be granted to LAVALLE <br /> EXCAVATING even if the project on 148th Street is 90% completed. <br /> MOTION: Lease made motion, seconded by Leroux, that an extension <br /> be granted to LaValle Excavating for Water Main Improve- <br /> ment Project No. 1975-2, for ten days from April 30 to <br /> May 10, 1976. <br /> VOTING FOR: Lease, Leroux, Schletty and Smith <br /> MOTION CARRIED <br /> NEIL PELTIER - drainage ditch - ditch has been excavated except <br /> that it should be extended further. If city would release all or <br /> part of $500 in escrow, they could purchase culvert and do the <br /> necessary work. Lease would like to know who the contractor is and <br /> have more details before releasinG the funds. <br />
