to 1.0 ORDINANCES AND RESOLUTIONS <br /> Off, 6.1 ORDINANCE COMMITTEE <br /> No . report. <br /> 6.2 PLANNING COMMISSION <br /> Leroux reported the Planning Commission is still short one member. <br /> 6.3 BUILDING IASPECTOR <br /> Presented report - asked for clarification regarding Agricultural <br /> zoning - reports people residing on ten acre tracts feel they are <br /> exempt from needing building permits - says it is his opinion <br /> that they are not agricultural simply because they have either a <br /> pony or a horse - Council agreed stating that they are not exempt <br /> unless they are earning their livlehood on the premises through <br /> an agricultural endeavor. <br /> 6.4 FIRE CHIEF <br /> No report. <br /> 6.5 POLICE CHIEF <br /> MOTION: Lease made motion, seconded by LaValle, to accept the <br /> monthly police report. <br /> VOTING FOR: Lease, LaValle, and Leroux. <br /> MOTION CARRIED <br /> 6.6 ATTORNEY <br /> HORTON - bond has been received - case can now be dismissed. <br /> Shepherd of the Fields Church - Deed is now acceptable - Possession <br /> of deed to roadway easement has not been received yet so there is <br /> no access to property at this time - has been reviewed with the <br /> church's attorney and they are aware of it. <br /> Septic System Ordinance - has not reviewed yet. <br /> Dennis Burdick - LaValle questioned whether the body shop was grand- <br /> fathered in. Lease said he told Burdick it was not. <br /> 6.7 ENGINEER <br /> Evergreen Hills 2nd & 3rd Plat - Vail told Engineer he had done <br /> considerable work regarding drainage and ponding, and was supposed <br /> to get designs and structures to turn in to Rice Creek Watershed <br /> District. Regarding road surfacing - $15,000.00 bond is in effect <br /> until October 15th. Lease asked Engineer to obtain measurements and <br /> estimate the blacktopping job. <br /> 6.8 CLERK <br /> A&W ROOT BEER - Last year wefe told to try to obtain drainage easement <br /> between the two property lines - at this time are having no trouble <br /> with dry well - Council feels they will not be able to obtain easement <br /> alternative would be to get a ditch system going over to 148th <br /> Street. LaValle felt bond should be released. Clerk requested to <br /> send them letter requesting them to renew their bond through January <br /> 1 , 1977. At that time, the Council will be in a better position to <br /> take the matter of elimination of the bond under advisement. <br /> Unemployment benefits - Clerk stated that cities do not pay into <br /> unemployment funds so when a city employee files a claim for benefits <br /> and the total claim is paid out, the city must re-imburse the state. <br /> A former police department part-time employee was paid $1 ,575.00 <br /> and the city has now been asked to re-imburse. <br /> MOTION: :!:laValle made motion, seconded by Leroux, to notify the <br /> Minnesota Department of Employment Services that the City <br /> of Hugo did not anticipate this expense and did not budget <br /> for it. Inform them he was a part-time employee and ascertain <br /> whether he was qualified to obtain unemployment compensation, <br /> and if so, ask if there are any emergency funds available. <br /> VOTING FOR: LaValle and Leroux. <br /> VOTING AGAINST: Lease. <br /> MOTION CARRIED <br />
