Mew — 6, 1977 7 55 <br /> Richard Schuh — Amended Mining Permit <br /> Mr. Schuh's attorney, Bruce Malkerson, presented the case to the Council. They <br /> had met with City Engineer, Kuusisto, to inspect the roads leading to the site. <br /> Mr. Malkerson felt that the $10,000bond and $10,000 letter of credit was sufficient <br /> to comply with anything asked of Mr. Schuh. Malkerson stated that there will be 9000 <br /> tone of blacktop hauled out, and 4500 tons of rock brought in on 152nd Street. <br /> The haul roads would be .aintained in compliance with recommendations of the City <br /> Engineer. The general contractor, Brainerd Blacktopping, would be responsible for <br /> dust control. LaValle stated that Fischer Contracting will be blacktopping Irish <br /> Avenue so there will be two parties using the same road. LaValle felt that an <br /> additional amount of letter of credit would be in order because of the blacktop <br /> road. The additional amount would cover additional liability. LaValle felt that <br /> an additional $15,000 would not be out of line. Kuusisto stated 152nd Street to <br /> County Road 57 was not in the best condition. There would have to be grading, <br /> excavation, and shaping prior to any hauling. Chloride would have to be added for <br /> dust control. Malkerson stated they do not have any Class 5 left. Would the Council agree to <br /> Class 3? Kuusisto stated that if the class 3 was not sufficient, Schuh would be asked <br /> to bring in Class 5 gravel. <br /> MOTION: LaValle made motion, seconded by Spitzer, that we amend the Mining <br /> Permit for Richard Schuh with the following changes: <br /> Item 4 — iaul roads shall be Irish Avenue South to County Road 8A <br /> and 152nd Street east to Jeffrey Avenue only. <br /> Item 7 — The contractor shall provide and maintain both a $10,000.00 <br /> bond and $25,000.00 irrevacable letter of credit for the <br /> maintenance and/or reconstruction of the haul roads, and to <br /> insure compliance of all conditions of the permit. <br /> Item 12 A speed limit of a maximum of 45 miles per hour be maintained <br /> by the contractor gravel trucks when operating on the haul <br /> roads on city streets, except a 30 mile per hour speed limit <br /> shall be maintained from 7:00 — 7:30 AM. <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail <br /> MOTION CARRIED <br /> Recess 9:20 PM Reconvened 9:31 PM <br /> 6.6 Police Chief <br /> Chief Barth submitted his monthly report. He stated that the reserve officers have <br /> completed their firearms training, and inquired as to the possibility of the reserves <br /> carrying firearms. LaValle felt it was too soon. They should be given as much training <br /> that is possible to give thim in the whole aspect of policing. Irsfeld agreed, stating <br /> the reserves should have more training and experience. Chief Barth is to supply the <br /> clerk's office with a roster of the reserves. <br />
