SEPTEMBER 19, 1977 87 <br /> VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. <br /> VOTING AGAINST: LaValle <br /> MOTION CARRIED <br /> MOTION: LaValle made motion, seconded by Spitzer, that we reopen <br /> discussion on the Shepherd of the Field's sign. <br /> VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. <br /> VOTING AGAINST: Spitzer <br /> MOTION CARRIED <br /> MOTION: Spitzer made motion, seconded by LaValle, that the matter Of <br /> Shepherd of the Fields sign be referred to the Planning Commission <br /> for resolution of the question of set back and. of the content of <br /> the sign, and may not be returned until matter is resolved. <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail <br /> MOTION CARRIED <br /> 5.9 Lavina Duraine - Special Use Permit <br /> The Special Use Permit has to be extended to coincide with Richard Schuh's Mining Permit. <br /> MOTION: Spitzer made motion, seconded by Schletty, to grant a Special <br /> Use Permit to Lavina Duraine, 1976-106-SUP, subject to the <br /> following conditions: <br /> 1. Original Special Use Permit is hereby extended until June <br /> 1, 1978. <br /> 2. Post bond in the amount of $5,000.00. <br /> 3. The bituminous hot mix plant should be allowed for the <br /> duration of Project 77-04-018. <br /> 4. All existing trees and natural vegetation bordering the pit <br /> area shall be left undisturbed. <br /> 5. All top soil in the pit area shall be stockpiled, and at the <br /> time the. operation is completed, the top soil shall be re- <br /> placed and seeded to grass cover. <br /> 6. Sewer facilities shall be of the portable, chemical holding <br /> tank type. <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. <br /> MOTION CARRIED <br /> 6.0 ORDINANCES AND RESOLUTIONS <br /> Item 8.2 of the agenda was discussed at this time (Procedure for amending rural & urban <br /> service districts in the city). Mr. Johnson stated that the complete ordinance will have <br /> to be published. The hearing cannot be held prior to 30 days of publication. The ordinance <br /> will have to be published again as it is finally stated. A certified copy will have to be <br /> filed with the County Auditor. <br />
