VOTING AGAINST: LaValle MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, that we reopen discussion on the Shepherd of the Field's sign. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. VOTING AGAINST: Spitzer MOTION CARRIED MOTION: Spitzer made motion, seconded by LaValle, that the matter Of Shepherd of the Fields sign be referred to the Planning Commission for resolution of the question of set back and. of the content of the sign, and may not be returned until matter is resolved. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED 5.9 Lavina Duraine - Special Use Permit The Special Use Permit has to be extended to coincide with Richard Schuh's Mining Permit. MOTION: Spitzer made motion, seconded by Schletty, to grant a Special Use Permit to Lavina Duraine, 1976-106-SUP, subject to the following conditions: 1. Original Special Use Permit is hereby extended until June 1, 1978. 2. Post bond in the amount of $5,000.00. 3. The bituminous hot mix plant should be allowed for the duration of Project 77-04-018. 4. All existing trees and natural vegetation bordering the pit area shall be left undisturbed. 5. All top soil in the pit area shall be stockpiled, and at the time the. operation is completed, the top soil shall be re- placed and seeded to grass cover. 6. Sewer facilities shall be of the portable, chemical holding tank type. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS Item 8.2 of the agenda was discussed at this time (Procedure for amending rural & urban service districts in the city). Mr. Johnson stated that the complete ordinance will have to be published. The hearing cannot be held prior to 30 days of publication. The ordinance will have to be published again as it is finally stated. A certified copy will have to be filed with the County Auditor.
