FEBRUARY 6, 1978 45 <br /> 7.0 ORDINANCES AND RESOLUTIONS CON"T. <br /> OF APARTMENT AND OTHER MULTI-FAMILY USES. <br /> VOTING FOR: LaValle, Spitzer, Irsfeld, and Vail. <br /> MOTION CARRIED <br /> 8.0 UNFINISHED BUSINESS <br /> 9.0 NEW BUSINESS <br /> 9.1 Charles Shubat - Road Extension <br /> Mr. Kuusisto stated that he would like to see the existing road and the <br /> proposed extension line up with each other. Mr. Shubat was present and <br /> stated that he has been unable to get Mr. Clifford Axelson's signature <br /> stating his approval of a 33' easement on his portion of the section line. <br /> He is in agreement, but will not sign anything. Mr. Johnson will draft a <br /> letter to Mr. Axelson stating the city's position and try to clarify the <br /> matter for him. <br /> MOTION: Spitzer made motion, seconded by Irsfeld, that the request <br /> to extend 130th Street be tabled until we get a letter to <br /> Mr. Axelson explaining what the city would like to see <br /> happen. <br /> VOTING FOR: LaValle, Spitzer, Irsfeld, and Vail. <br /> MOTION CARRIED <br /> 9.2 Joseph Stanek - Road construction <br /> Mayor LaValle has received numerous correspondence regarding the proposed <br /> construction of a road (extension of Jeffrey Avenue) . Mr. Stanek would <br /> like to connect with Mr. Pogreba's road, and create public road. How— <br /> ever, there is a powerline constructed on the section line of the property. <br /> Mayor LaValle will let the matter sit at this time. <br /> 10.0 MISCELLANEOUS <br /> The matter of the extension of Keystone Avenue has been reopened. The city <br /> had maintained the road for 6 years at one time, so the city is liable for <br /> its maintenance. However, at this time, there are trees fallen across the <br /> roadway making passage difficult. Mr. Johnson stated that if the city has <br /> maintained the road for six (6) years, it would be considered public right <br /> of way. LaValle stated that if they wanted the road upgraded they would <br /> have to wait on a priority basis. Mr. LaValle will be contacting the parties <br /> involved to try and resolve the matter. He will also investigate the poss- <br /> ibility of obtaining an extra easement to widen the road. <br /> The clerk stated that Washington County will no longer issue a letter <br /> stating that an alleged owner is in fact the owner. <br /> MOTION: Irsfeld made motion seconded by Spitzer, that the City <br /> of Hugo accept two (2) ways to show proof of ownership: <br /> 1 . A current attorney's opinion. <br />
