It was determined that a 40' easement will be required on Lot 6, <br /> Block 2, Evergreen Hills 2nd Addition, and a 45' easement on Outlot A. It was <br /> suggested that not more than $100.00 be offered in compensation for the easements. <br /> MOTION: Spitzer made motion, seconded by Irsfeld, authorizing the City <br /> Attorney and Councilman Schletty to proceed with the acquisition <br /> of easements necessary for the relocation of the earthen dam. <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail <br /> MOTION CARRIED <br /> 5.4 Thomas Zimmerman - Special Use Permit <br /> Mr. Zimmerman provided the Council with the following, requested information: des- <br /> cription of business, site plan, information and location on proposed road, a permit <br /> form Rice Creek for the ditch crossing, and building plans. Kuusisto had no pro- <br /> blem with the use of the chemical toilet, as long as an approved perc test is <br /> provided in relative proximity of the proposed building. <br /> MOTION: Spitzer made motion, seconded by Irsfeld, to grant a Special Use <br /> Permit to Thomas S. Zimmerman for the operation, maintenance, and <br /> storage of firewood supply, and construction of a 60' x 70' pole <br /> barn to use in the operation at the Wi of NE4 and the NI of SE4 of the <br /> NE4 and W of W1 of Si of SE* of NE4f Section 32, in accordance with <br /> the Site Plan as submitted. Subject to the following conditionss <br /> 1. The building to be constructed in accordance with the plans <br /> submitted and so positioned relative to perc test that a valid <br /> building Permit can be obtained. <br /> 2. That the access road south from 130th Street to be completed <br /> not later than July 1, 1981. <br /> 3. During period of the construction of the access road, the haul <br /> road will be designated as 130th Street and Goodview Avenue. <br /> Such route to be vacated upon completion of the access road. <br /> 4. Dust suppression measures shall be installed at the expense of <br /> the permit holder to protect those residences existing along <br /> the temporary haul route. <br /> 5. Hours of operation shall be restricted to the hours between 7:00 AM <br /> and 7:00 PM, local time, Monday through Saturday. Additional hours <br /> by special authorization only. <br />
