04 AUGUST 6, 1979 <br /> Roger Gfrerer - cont. <br /> MOTION: Schietty made motion, seconded by Spitzer, to approve <br /> the Variance request of Roger Gfrerer, to construct a <br /> 3-car garage with a 25' front yard setback instead of <br /> the required 40' setback. <br /> VOTING FOR: LaValle, Spitzer, Schietty and Vail <br /> MOTION CARRIED <br /> 5.8 Bill Clark - Special Use Permit <br /> Mr. Clark has requested a Special Use Permit to construct a single <br /> family dwelling at Royal Haven 1 , Lot 5, Block 1 . Mr. Clark has sub- <br /> mitted the requested data regarding the elevations and topography of <br /> the lot. Spitzer expressed concern regarding the amount of fill re- <br /> quired, and suggested that a financial guarantee be obtained in case <br /> of erosion of the fresh fill. <br /> MOTION: Spitzer made motion, seconded by Vail, to approve the <br /> request of Bill Clark for a Special Use Permit to con- <br /> struct a house on Lot 5, Block 1 , Royal haven Estates 1 , <br /> subject to the following: <br /> 1 . All fill and grading described on the sketches of <br /> record shall be accomplished on or before October 1 , <br /> 1979. <br /> 2. Erosion control provisions, satisfactory to the City <br /> Engineer, shall be installed as a part of the altera- <br /> tion of the topography. <br /> 3. An irrevocable letter of credit, in' the amount of <br /> $2,500.00, made in favor of the City of Hugo, shall <br /> be provided to insure the efficacy of the erosion <br /> control arrangement. Letter of Credit to run through <br /> December 31 , 1980. <br /> 4. A bond, in the amount of $2,500.00, made in favor of <br /> the City of Hugo, shall be provided to insure the <br /> maintenance of elevations and topographical alterations <br /> as created. Bond to run through July 1 , 1982. <br /> 5. The construction of buildings and improvements shall <br /> conform substantially to plans as submitted and on <br /> file. <br /> 6. An easement to provide for flood plain control shall <br /> be provided and made a matter of record, staisfactory <br /> to the City Engineer. <br /> 7. The Special Use Permit shall become void if not signed <br /> and executed by the petitioner by September 15, 1979. <br /> 8, The owner shall provide a statement from the Washington - <br /> County Abstract C.o. that no transfer of ownership has occurred <br /> since January 13, 1978. <br />
