Matter to be
discussed at meeting of April 5, 1982, and Mr. Vail to provide copies of
the final draft to the professional staff as soon as possible for their
review.
VOTING FOR: LaValle, McAllister, Schletty, Vail
MOTION CARRIED
5.4 First State Bank of Hugo - Letter of Credit
The Building Inspector was to make a report regarding the inspection made of the
facilities at the bank; specifically, the basement area. There was no report
available for the Council's review.
5.5 Lester Schmidt - Minor Subdivision
Mr. Meyers, attorney for PHD Industry and Palsa Bottling, was present to explain
the situation to the Council. Mr. Lester Schmidt is the fee owner of Lot 3,
Block 2, Bald Eagle Industrial Park. There is an application to divide the parcel
into 3 lots: Parcel A to be retained by Grace Development, Parcel B - PHD In-
dustries, and Parcel C - Palsa Bottling Company. PHD wanted to be assured that
Parcel B would accommodate a 15,000 sq ft building. Mr. Meyers stated that a title
opinion will be submitted at a later date, with review by the City Attorney.
The 1981 assessments will have to be recalculated on a per foot basis, with sewer
stubs assessed to the benefitted parcels. At a previous date, the city was in-
formed that no action is to be taken on matters regarding Grace Development unless
both Mrs. Jackson and Ken Tschida were present. Because this matter was tried by
Washington County and approved in court, Attorney Johnson requested a letter from
Grace Development's attorney stating that they agreed to the action.
MOTION: McAllister made motion, seconded by Vail, to approve the Minor Subdivision
for Lester Schmidt, to divide Lot 3, Block 2, Bald Eagle Industrial Park,
into three (3) parcels, subject to the following:
1 . Receipt of a title opinion.
2. Final authorization by City Attorney's office.
3. The collection of all expenses incurred by the city.
4. A letter from the attorney representing Grace Development stating that
they agreed to the subdivision.
5. The motion f cr approval is contingent on above items completed within
30 days.
VOTING FOR: LaValle, McAllister, Schletty, Vail
MOTION CARRIED
