46 <br /> MOTION: McAllister made motion, Schletty seconded, that the matter be placed on <br /> the agenda for June 7, 1982. <br /> VOTING FOR: McAllister, Schletty, Irsfeld, Vail <br /> MOTION CARRIED <br /> 7.1 EMS Contract <br /> The proposed contract was reviewed by Attorney Johnson, and he questioned only <br /> aspect of the contract. There was no copy of the by-laws attached as indicated, <br /> and the Fire Chief that he would see to it that a copy was sent to Mr. Johnson <br /> for his review. <br /> MOTION: Irsfeld made motion, Schletty seconded, to place this matter on the agenda <br /> for June 7, 1982. <br /> VOTING FOR: McAllister, Schletty, Irsfeld, Vail <br /> MOTION CARRIED <br /> 5.2 Richard Vail - Permission to use Balif fields <br /> Mr. Vail requested exclusive use of the city's ball fields on June 12th for a one <br /> day tournament. He and his team, McCullough Well Drilling, would be responsible <br /> for maintenance. <br /> MOTION: McAllister made motion, Vail seconded, granting approval to McCullough <br /> Well Drilling softball team to use the city's ball fields on June 12, 1982, <br /> for a one day tournament. They are to be responsible for park maintenance <br /> on that day. <br /> VOTING FOR: McAllister, Schletty, Irsfeld, Vail <br /> MOTION CARRIED <br /> 5.3 Dennis Johnson - Energy Savers <br /> Mr. Johnson, Energy Savers, and Mr. Bennett, the manufacturer's rep, were present <br /> to tyr resolve the matter of the warranty on labor. The contract called for a 15 <br /> year warranty on materials and labor, and Mr. Johnson has been able to supply a <br /> 15 year warranty on materials and 10 years on labor. Mr. Johnson stated that he <br /> is unable to obtain the additional 5 years for labor. Irsfeld felt that the City <br /> certain options, two of which are retention of a cash amount or legal action. Mr. <br /> Johnson had paid $344.50 for the additional 5 year warranty on materials, and stated <br /> that he did not object to the city retaining that amount from the money owned him, <br /> to compensate for the discrepancy. <br /> MOTION: Schletty made motion, seconded by McAllister, approving a change order <br /> amending the warranty for labor from 15 years to 10 years in consideration <br /> of reduction of the contract price as amended. <br /> VOTING FOR: Schletty, Irsfeld <br /> VOTING AGAINST: Vail, McAllister <br /> MOTION CARRIED <br /> MOTION: Vail made motion, McAllister seconded, for a change order to the amount <br /> of $344.50 to be kept to reduce the warranty on labor from 15 years <br /> to 10 years, for Project 8118. <br /> VOTING FOR: McAllister, Irsfeld, Vail <br /> VOTING AGAINST: Schletty <br /> MOTION CARRIED <br />
