May 17, 1982 47 <br /> The regular meeting was adjourned and the public hearing to consider the vacation <br /> of the easement of David Schuman at 8:00 PM. <br /> Mrs. Waller and her daughter were present and requested that the city prove to them <br /> that there was indeed an easement on their property. After investigation at Washing- <br /> ton County, they could find no substantiation that an easement ever was recorded. <br /> Attorney Johnson stated that old township easements were not necessar:.ly recorded <br /> when required to do so. It was the recommendation of the engineer that the city <br /> retain the 66' easement until it deflects to the south, and vacate the balance <br /> of the easement on the Schuman property. He stated that the city will ultimately <br /> require a drainage easement for the Schuman property. The public hearing was <br /> closed at 8:26 PM. <br /> MOTION: Irsfeld made motion, McAllister seconded, that the vacation of the easement <br /> for David Schuman not be addressed, and at that time, based on the City <br /> Engineer's recommendation, address only that part of the easement lying <br /> completely within the Schuman property, excluding that running along the <br /> northeasterly corner of Section 27. <br /> VOTING FOR: McAllister, Schletty, Irsfeld, Vail <br /> MOTION CARRIED <br /> Mrs. Schuman stated that she will provide Mr. Kuusisto with a copy of the drainage <br /> plan for the property to be subdivided. <br /> The public hearing to consider the vacation of the cistern easement located on the <br /> bank property was called to order at 8:29 PM. <br /> There was no one present to comment on this matter. The vacation of the easement <br /> was petitioned by the First State Bank of Hugo. <br /> The public hearing was closed at 8:30 PM. <br /> MOTION: McAllister made motion, seconded by Vail, to adopt RESOLUTION 1982-4, A <br /> RESOLUTION FOR THE VACATION OF THE CISTERN EASEMENT AS FURTHER DESCRIBED. <br /> VOTING FOR: McAllister, SChletty, Irsfeld, Vail <br /> MOTION CARRIED <br /> 5.6 Lloyd Halverson - Special Use Permit <br /> The Halverson's would like to construct a 22 x 22 wood frame accessory building on <br /> their property located at 5835 148th Street. A signed letter from adjoining pro- <br /> perty owners was submitted stating they had no objection to the building. <br /> MOTION: McAllister made motion, Schletty seconded, to approve the Special Use Per- <br /> mit for Lloyd Halverson, to construct a 22 x 22 wood frame accessory <br /> building on property located at 5835 148th Street North. <br /> VOTING FOR: McAllister, Schletty, Irsfeld, Vail <br /> MOTION CARRIED <br /> 5.7 James Husnik - Preliminary Plat Approval <br /> Mr. Kuusisto inspected the ponding area located in the proposed subdivision, and <br /> recommended fencing of the area.
