58 June 21, 1982 <br /> MOTION: LaValle made motion, Vail seconded, that the First State Bank of Hugo's <br /> Letter of Credit, in the amount of $2,000, be released. The terms of <br /> the Site Plan Approval have been fulfilled. <br /> All aye. Motion Carried. <br /> 5.3 Bill Clark - Expiration of Bond <br /> The $2500 bond guarantees elevations for the lot where the house is constructed, <br /> and not the lot where the fill was removed. A letter had been sent to Mr. Clark <br /> requesting an extension for the bond if the erosion control measures, as pre- <br /> viously specified, had not been satisfied. As of this date, the City had no <br /> response from Mr. Clark. <br /> MOTION: LaValle made motion, McAllister seconded, that the Bill Clark erosion <br /> control matter be dropped from consideration, because bond does not <br /> guarantee erosion control in this matter. <br /> All aye. Motion Carried. <br /> 5.4 John Norton - Special Use Permit <br /> Mr. Norton submitted a new plan for the filling of his lot - Lot 7, Block 1 , <br /> Royalhaven Estates. Mr. Norton stated that his financing will expire the end of <br /> July, 1982, and would like city approval to fill his lot. Norton stated that it <br /> _would take approximately 3,000 square yards of fill to complete the job. The <br /> intent is to take the fill from Mr. Norton's lot across the road, but he has <br /> not ruled out the possibility of purchasing the gravel commercially. A perc <br /> test was submitted for Lot 7, and the proposed septic system will be located on <br /> the same lot as the house. Mayor LaValle was not comfortable with the idea of <br /> filling another lot on Sunset Lake, and questioned the long-range effects on the <br /> lake. Mr. Kuusisto stated that he had no problem with the proposed septic system. <br /> If the original system failed, the city would like to dedicate a portion of Mr. <br /> Norton's lot lying across the street from the house to insure an alternate site <br /> is available. <br /> MOTION: Irsfeld made motion, Vail seconded, to approve the Special Use Permit <br /> for John Norton to fill Lot 7, Block 1 , Royalhaven Estates, subject to <br /> the following: <br /> 1 . Approval from Rice Creek Watershed District. <br /> 2. Grading plan on Lot 6 for removal of the fill. <br /> 3. Approval of the septic system by our engineer, with a guarantee of <br /> dedicated alternate sewer site. A Letter of Credit, in an approximate <br /> amount of $8,000, be submitted. The exact amount to be determined at <br /> a later date. The Letter of Credit is to run two (2) years after the <br /> date of installation of the septic system, and shall be extendable' <br /> upon request of the City. <br /> The retaining wall, in relation to the abutting property, must be <br /> addressed and design standards meet with City approval. <br /> A Letter of Credit, in an amount to be determined at a later date, be <br /> submitted to the City, guaranteeing proper erosion control on Lot 6, <br /> if and when dirt is to be removed. <br />
